New Regulation on Fluorinated Greenhouse Gases Published

The Regulation on Fluorinated Greenhouse Gases was published in the Official Gazette dated 15 October 2024 and numbered 32693.
 
The purpose of the Regulation is to regulate the procedures and principles regarding the management of fluorinated greenhouse gases and other fluorinated substances in order to control the emission of fluorinated greenhouse gases within the scope of the Montreal Protocol on Substances that Deplete the Ozone Layer, to which our country is a party.
 
Regulations;
 
a) Principles regarding the labeling of fluorinated greenhouse gases and other fluorinated substances, including those in products and equipment, data collection, leakage controls, reporting, marketing, import, export and use, quota distribution, recovery, recycling, reclamation and destruction of fluorinated greenhouse gases,
 
b) Issues and regulations regarding the training and certification of natural and legal persons who intervene in equipment containing fluorinated greenhouse gases or whose operation relies on these gases,
 
covers.
 
The Regulation does not cover the recovery of fluorinated greenhouse gases from air-conditioning equipment in motor vehicles.
 
The Regulation has been prepared within the framework of compliance with the European Union legislation, taking into account the Regulations (EU) No. 517/2014 dated 16/4/2014 and (EU) No. 2024/573 dated 7/2/2024 on Fluorinated Greenhouse Gases of the European Parliament and of the Council.
 
Fluorinated greenhouse gases and other fluorinated substances;
 
a) Emission to the atmosphere,
 
b) Disposal of the product, equipment or container without recovery of fluorinated greenhouse gases or other fluorinated substances within the container, product or equipment, except those used as blowing agents in the foam product or device foam insulation,
 
will not be done.
 
When the product and/or equipment is decommissioned or the container has reached the end of its life, the waste management of the product, equipment or container will be carried out in accordance with the Waste Management Regulation published in the Official Gazette dated 2/4/2015 and numbered 29314.
 
Reporting of fluorinated greenhouse gases or other fluorinated substances will be done through the Activity Reports Database (FARAVET).
 
Licensing of import and export of hydrofluorocarbons on an import/export basis
 

Those who will import or export hydrofluorocarbons must have a hydrofluorocarbon control certificate for each import/export.

 

A hydrofluorocarbon control certificate per import is issued by the Presidency to those who will import hydrofluorocarbons, in accordance with the quota allocation.

 

The hydrofluorocarbon control certificate is valid for the year in which it was obtained. Import and export transactions based on the hydrofluorocarbon control certificate must be completed within the year in which the hydrofluorocarbon control certificate is valid. However, if import and export transactions cannot be completed due to force majeure, the Presidency may grant a period of up to one month to complete import and export transactions valid for the year in which the hydrofluorocarbon control certificate is obtained, provided that the force majeure is notified to the Presidency promptly by the end of the year. In any case, this period cannot exceed January 31.

 

A hydrofluorocarbon control certificate is not required for imports of hydrofluorocarbons subject to export within the scope of the Inward Processing Regime Decision, enacted by the Council of Ministers Decree No. 2005/8391, dated January 17, 2005. However, registration with the FARAVET system is mandatory for the importer.

 

A hydrofluorocarbon control certificate is not issued for use in export operations and transactions to countries where the import of disposable containers containing fluorinated greenhouse gases is prohibited.

 

Application fees, procedures and principles regarding the hydrofluorocarbon control certificate are determined by the Presidency.

 
The Regulation on Fluorinated Greenhouse Gases published in the Official Gazette dated 29/6/2022 and numbered 31881 has been repealed.
 
The regulation;
 
The second paragraph of Article 9 and the fourth paragraph of Article 10 on 1/1/2025,
 
Other provisions on the date of publication,
